House of Booch · Effective Date: 01 October 2026 · Last Updated: 11 October 2026

1. Introduction

Welcome to House of Booch, a Kenyan premium kombucha brand.

These Terms and Conditions govern your access to and use of our website and the purchase of products through our online store.

In these Terms and Conditions, “House of Booch”, “we”, “us”, and “our” refer to House of Booch, while “you” and “your” refer to any customer or visitor using our website.

By accessing our website or placing an order, you agree to these Terms and Conditions. Please read them carefully before making a purchase.

If you do not agree with these terms, please do not use our online store.

2. Eligibility

You must have the legal capacity to enter into a binding agreement to purchase products through our website.

If you are purchasing on behalf of a business or another individual, you confirm that you are authorised to act on their behalf.

You agree to provide accurate, complete, and current information when placing an order.

3. Our Products

House of Booch offers premium kombucha and related products as described on our website.

We aim to ensure that all product descriptions, photographs, prices, sizes, flavours, ingredients, and other product information are accurate and up to date. However:

  • Product photographs are illustrative and may differ slightly from the actual packaging or presentation.
  • Product availability may change without notice.
  • Ingredients, packaging, and product specifications may change where necessary, subject to applicable legal requirements.
  • Any product-specific storage instructions, expiry dates, batch information, and consumption guidance provided on the packaging should be followed.

We will not knowingly misrepresent the products we sell. Nothing in these Terms and Conditions removes your statutory consumer rights.

4. Product Safety and Consumption

Kombucha is a fermented beverage. Customers should read the product label, ingredient information, storage instructions, and any relevant warnings before consumption.

You agree to follow the storage and handling instructions provided on the product packaging.

House of Booch shall not be responsible for product deterioration caused by improper storage, mishandling, contamination, or failure to follow the instructions provided, to the extent permitted by applicable law.

If a product appears damaged, contaminated, spoiled, incorrectly labelled, or otherwise unsafe, do not consume it. Contact us promptly with your order details and relevant product information so that we can investigate and determine the appropriate remedy.

Product descriptions and marketing materials are provided for informational purposes and are not a substitute for professional medical advice. We do not represent our products as a treatment or cure for any disease unless expressly permitted by applicable law and supported by appropriate evidence.

5. Product Availability

All products displayed on our website are subject to availability.

We reserve the right to limit quantities, discontinue products, or temporarily remove products from sale.

If a product becomes unavailable after you place an order, we will inform you and discuss an appropriate solution, which may include a refund or an alternative agreed upon with you.

We will not substitute a product without your agreement.

6. Ordering Process

Customers may place orders through our website by selecting products, adding them to the shopping cart, providing the required information, selecting an available payment method, and completing checkout.

Before submitting an order, please review the following:

  • Selected products and quantities.
  • Applicable product prices.
  • Delivery charges and other disclosed fees.
  • Delivery address and contact information.
  • Payment method and total amount payable.

You are responsible for checking that your order details are accurate before submitting your order.

After receiving an order, we may send an acknowledgement confirming that the order has been received. An acknowledgement of receipt does not necessarily mean that the order has been accepted.

An order will be accepted when we issue an order confirmation or otherwise expressly confirm acceptance.

If we cannot fulfil an order, we will notify you and arrange any applicable refund for payments received for the unfulfilled order.

We may decline or cancel an order where reasonably necessary, including in cases of suspected fraud, payment failure, incorrect pricing, stock unavailability, or an inability to deliver to the specified address. Where payment has already been received, applicable refunds will be processed in accordance with these Terms and Conditions and applicable law.

7. Pricing and Payment

All product prices will be displayed on our website in Kenyan Shillings (KES), unless otherwise stated.

The price payable for an order will be the price displayed at checkout when the order is submitted, subject to correction of genuine errors and applicable law.

Delivery charges, applicable taxes, and any other mandatory fees will be disclosed before you complete your purchase.

We may accept payments through M-Pesa and other payment methods made available at checkout.

When making a payment, you agree to follow the instructions provided by the relevant payment service.

An order requiring payment will not ordinarily be processed for dispatch until the payment has been successfully confirmed, unless we expressly agree otherwise.

House of Booch will not ask you to disclose your M-Pesa PIN, banking PIN, or other confidential payment credentials to our staff.

If a payment is deducted but your order is not confirmed, please contact us with the transaction reference so that we can investigate.

We reserve the right to correct genuine pricing or technical errors. If an error affects your order, we will contact you before proceeding with the affected transaction. If payment has already been made and the order cannot be fulfilled, we will arrange an appropriate refund.

8. Delivery and Order Fulfilment

We deliver orders to the locations and within the service areas indicated on our website or otherwise confirmed by us.

Available delivery options, estimated delivery times, and delivery charges will be communicated during checkout or before the order is confirmed.

Delivery times are estimates unless a specific delivery commitment has been expressly agreed upon.

We will make reasonable efforts to deliver orders within the communicated timeframe. However, delays may occur due to traffic, weather conditions, operational disruptions, or other circumstances beyond our reasonable control.

If a significant delay occurs, we will communicate with you and discuss the available options.

Customers are responsible for providing accurate delivery addresses, telephone numbers, and instructions.

If delivery fails because the customer provided incorrect details, was unavailable to receive the order, or could not be reached using the provided contact information, we may arrange redelivery and communicate any reasonable additional charges before applying them.

Any additional delivery charges must be disclosed and must not override applicable consumer rights.

Risk of loss or damage passes in accordance with applicable law. We remain responsible for addressing delivery-related issues where required by law.

9. Order Cancellation

If you wish to cancel an order, contact us as soon as possible using our official customer support details.

We will make reasonable efforts to accommodate cancellation requests received before an order has been dispatched.

Once an order has been dispatched, cancellation may not be possible in every circumstance. We will assess the request in accordance with applicable law and our Returns and Refunds Policy.

Nothing in this section limits any statutory cancellation rights you may have under Kenyan law, including rights applicable to online or remote consumer agreements.

Where an order is cancelled and a refund is due, we will communicate the applicable refund process and timeframe.

10. Returns, Exchanges, and Refunds

House of Booch is committed to supplying products that match their descriptions and meet applicable quality and safety requirements.

Because kombucha is a consumable beverage, returns must be handled with particular attention to product freshness, hygiene, packaging integrity, and safety.

Full detail on eligible returns, reporting a problem, change-of-mind returns, and refund processing is set out in our Shipping & Returns Policy.

11. Customer Responsibilities

  • Provide accurate information when placing an order.
  • Use the website lawfully and responsibly.
  • Avoid fraudulent orders or payment activity.
  • Avoid attempting to gain unauthorised access to our systems.

  • Follow product storage and consumption instructions.

We reserve the right to investigate suspected fraudulent activity and take reasonable measures to protect our customers, website, and business.

12. Website Use and Intellectual Property

Unless otherwise stated, the content on our website, including our brand name, logos, product photographs, descriptions, graphics, designs, and other original materials, belongs to House of Booch or is used under appropriate permission.

You may browse our website and use its content for personal, non-commercial purposes.

You must not reproduce, distribute, modify, publish, or commercially exploit our website content without prior written permission, except where permitted by law.

You must not use our website to distribute malicious software, conduct unauthorised activities, or interfere with the operation of our services.

13. Promotions, Discounts, and Offers

From time to time, House of Booch may offer discounts, promotional codes, product bundles, or other special offers.

Unless expressly stated otherwise, promotions:

  • Are subject to the specific terms communicated with the offer.
  • May be limited to specified products, quantities, customers, or periods.
  • Cannot be exchanged for cash unless expressly stated.
  • May not be combined with other offers unless permitted by the relevant promotion.

We reserve the right to withdraw or amend a promotion where reasonably necessary, subject to applicable law and any rights already acquired by customers.

14. Privacy and Personal Information

We collect and process personal information in accordance with our Privacy Policy and applicable Kenyan data protection laws.

Information provided during browsing, checkout, payment, delivery, or customer support may be used to process orders, provide services, communicate with customers, and meet legal obligations.

We may share relevant information with payment providers, delivery partners, website service providers, and other authorised parties where necessary and lawful.

15. WhatsApp Business and Electronic Communications

House of Booch may communicate with customers through email, telephone, WhatsApp Business, and other electronic channels.

These communications may include order confirmations, payment updates, delivery notifications, customer support responses, and promotional messages where permitted by law.

You are responsible for providing accurate contact information and maintaining access to the communication channels you provide.

Promotional communications are subject to applicable consent requirements and our Privacy Policy. You may opt out of marketing communications at any time.

16. Product Quality and Consumer Rights

House of Booch aims to supply products that correspond with their descriptions and meet applicable quality and safety requirements.

Nothing in these Terms and Conditions excludes, restricts, or replaces any consumer right, statutory warranty, or legal remedy that cannot lawfully be excluded or restricted.

If you believe a product does not meet the applicable requirements, please contact us so that we can investigate and provide an appropriate response.

17. Limitation of Liability

To the extent permitted by applicable law, House of Booch will not be liable for losses arising from circumstances beyond our reasonable control, including disruptions to third-party payment services, delivery networks, or website hosting services.

We are not responsible for losses caused by inaccurate information provided by a customer, misuse of a product, or failure to follow product storage instructions, to the extent permitted by law.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, including liability relating to fraud, applicable product safety obligations, or consumer rights that cannot lawfully be excluded.

18. Events Beyond Our Control

We will not be considered in breach of these Terms and Conditions solely because performance is delayed or prevented by circumstances reasonably beyond our control.

These circumstances may include severe weather, transport disruptions, power or network failures, public emergencies, and other events that could not reasonably have been prevented.

Where such circumstances affect an order, we will take reasonable steps to inform affected customers and discuss an appropriate solution.

This section does not remove any applicable statutory right to cancel an order or obtain a refund.

19. Complaints and Dispute Resolution

If you have a complaint about our products, website, payments, or delivery services, please contact House of Booch using the official contact details published on our website.

We will review the complaint and make reasonable efforts to resolve it fairly and promptly.

Please provide your order number and relevant supporting information to help us investigate.

If a dispute cannot be resolved directly, you may pursue any remedies available under applicable Kenyan law, including approaching the relevant consumer protection authority or court.

20. Changes to These Terms and Conditions

We may update these Terms and Conditions to reflect changes in our products, website functionality, payment methods, delivery arrangements, or applicable legal requirements.

The latest version will be published on this page with an updated “Last Updated” date.

Changes will apply prospectively unless otherwise required by law or agreed with the customer. Changes will not remove rights already acquired under an existing order.

We encourage customers to review these terms periodically.

21. Governing Law

These Terms and Conditions are governed by the laws of Kenya, including the Consumer Protection Act, 2012, the Sale of Goods Act, and other applicable legislation.

Any dispute arising from these Terms and Conditions will be handled in accordance with the applicable laws and procedures of Kenya.
